TERMS AND CONDITIONS

CUSTOM MADE TO ORDER ITEMS

Custom and ‘Made to order’ products are purchased by SLOWE Living Ltd directly from the manufacturer specifically at the customers request. These items are designated as ‘Bespoke and customised goods’ under the Consumer Rights Act 2015 and are exempt from cancellation rights.

All Custom and ‘Made to order’ products are subject to a manufacturers lead-time guidance. The lead-time stated on product pages are estimates, based on manufacturing expectations of the item from our supplier once the order has been received.

As a client (hereby known as “you”) of SLOWE Living (hereby known as “SL” “we” or “us”), we would like to familiarise you with the process of placing an order with us, to ensure that your SL experience is a satisfying one. ORDERING

​

An order is considered ‘placed’ on receipt of a deposit payment, this will be confirmed by return of a deposit invoice noting the amount paid, ordinarily, no further payment will be due until despatch. If you have an existing trading arrangement orders can be placed by the issue of a “purchase order” (PO). You will be notified if for any reason we cannot accept a PO. Once a PO has been accepted by us you will be issued with a “Deposit Invoice” and manufacture will commence, you will be liable to pay this invoice within the agreed terms usually 14 days. This invoice will not be void in the event of a cancellation.

 

Once an order has been ‘placed’ by the above means, no cancellation of that order will be valid unless you receive written communication endorsing the canceled order. Due to the bespoke nature of our products your deposit is not refundable, in some circumstances, a company credit may be issued for the deposit amount less the value of any abortive work undertaken.

 

 

LEAD TIMES

​

The “lead time” is defined as the number of weeks/days from the placement of an order to its completion ready for shipment. Any quotation or proforma invoice is calculated on the basis of the stated lead time. It may be possible to reduce this time, this will usually attract an expediting fee calculated at 5% of the product cost per week, this fee is to cover overtime costs, additional fees from our suppliers, additional transportation costs during manufacture etc. It is always our preference not to expedite orders. We will make every effort to complete orders within the agreed lead time. SL will not be liable to pay any late penalties or damages unless these are expressly quantified in advance and form part of a written contract between the parties, the contract must relate to an order and cannot be a general set of conditions or implied conditions. SL will not be liable to pay third party costs arising from work instructed by others or any other cost arising from delayed completion of an order.

The lead time does not include the time for the manufacturer to ship the item to SL. As soon as we receive the goods we will contact you to arrange delivery.

In the vast majority of cases the lead-time is an accurate representation of how long you may be expected to wait for an item to be produced. However sometimes there can be problems with over-demand or quality/production issues in manufacturing, which in turn lead to delays with the order. In these cases we will keep you informed, but we cannot accept liability for any loss or inconvenience that may result from the delay.

DELIVERY

​

Delivery times are estimates only and we are unable to accept any liability for failure to deliver the products within the specified time resulting from shipment/delivery delays from our suppliers. Delivery times will be arranged with you in advance. If you are unable to accept delivery within fourteen (14) days from completion, the invoice must then be paid in full. In addition, a storage fee of £200 per week will be payable. Storage fees will be invoiced to you on a weekly basis until delivery has been completed and are payable prior to final delivery. If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for transport and re-delivery costs. You are responsible for ensuring that there is adequate access and entry to the premises to allow delivery of the products.

 

Any additional costs in relation to access into the premises, eg, forklifts, are your responsibility. If it is not possible for the products to be delivered into your premises, the products will be returned to our warehouse and you will be invoiced for transport and re-delivery. In addition, the above storage charges will apply. We reserve the right to make part deliveries of any order and each part delivery shall constitute a separate contract in respect of the products delivered on the same condition as set out herein.

 

At any point in time, a 50% deposit must be maintained for all undelivered goods. Failure to deliver all the products you have ordered shall not invalidate the contract as regards any part deliveries. All products will remain the property of SL until payment is received in full and delivered from SL’s premises or the premises of any SL appointed shipping or storage agent. Should you be arranging your own delivery then the goods become your responsibility upon collection from SL’s premises or the premises of any SL appointed shipping or storage agent.

MATERIAL & FINISH​

​

All wood used in the production of your order is carefully handled and selected from our trusted suppliers. As wood is a natural product, variations in colour and pigmentation will occur. Wooden furniture will also change appearance over time as it is affected by the environment in which it is placed. We will be unable to accept return or issue refund for products that have natural variation in colour, pigmentation and grain. As wood remains a natural product after production, there is the possibility of natural movement throughout the lifetime of the product. This may result in warping, checking or cracking, due to the factors that may cause these changes being out of our control we will not be able to accept return or complaint for such changes.

All wood if subjected to changes in moisture content, e.g. in a centrally heated house, and especially if the coating does not stop changes in moisture. The amount of movement will vary with the individual piece of wood, and how much change there is in the moisture content.

INSPECTION

​

You are required to inspect your products when you take delivery of them. You will be required to note any damage on the delivery documentation, which is presented to you by the carrier for signature. In all other cases, you will be required to notify us in writing of any damage or shortages within seven (7) calendar days of delivery. We will not be liable for any damage to any of the products unless we are notified within the time period specified above.

RIGHTS TO RETURN

​

Unless goods are faulty, and we are duly notified as outlined above, we are unable to refund, exchange or credit your account. In case of goods defective in materials or workmanship please see our Warranty document for an outline of our warranty policy.

OUR LIABILITY

​

We will not be responsible for ensuring that the products are suitable for a particular purpose unless it is self-evident or is made known to us. Further, we will not accept responsibility for the suitability or strength of any fixing/installation work conducted by any other company or individual. Nothing in the contract will limit or exclude our liability for death or personal injury caused by our negligence or for fraud. If you are a consumer, then nothing in these terms and conditions will affect your statutory rights.

PERSONAL INFORMATION

​

Your address and contact details may be used by SLOWE Living to administer your order, honour your warranty, troubleshoot or recall items, your details will be held securely, we will only ever refer to your details for this purpose. We will not provide you with any marketing, product information or event invites unless you expressly request this. INSTILLATION 

​

Installation or supervision of an installation will only be provided where it has been explicitly agreed and is duly noted in writing on the product invoice. Unless otherwise noted installation excludes alterations to the building fabric to accommodate the fixture. Unless otherwise noted, the installation will be in a single phase, should the installation be required in multiple phases additional fees may be required. If we attend a site to supervise or install and it is not possible to complete the works for reasons outside of our control (e.g. site not ready) you may be charged for the visit.

PRICING & TAX​

​

Prices listed on this website are in British Pounds. Prices do not include applicable sales tax or shipping and are subject to change. Laws regarding taxation of merchandise, freight and handling are subject to destination; to be determined with each order. We the seller reserve the right to restrict or cancel any order.

SHIPPING

​

We ship to the whole of mainland UK with our standard shipping rate. We currently are not shipping to the EU and International shipping.

Our lead times change every so often based on material demand, so check the product pages to see what the lead time is at the point of your order. We aim for 8-10 weeks.

If a product has been damaged in transit then give us a call. After we’ve seen a photo of the damage, we will work out the best way to have your product repaired or replaced as soon as possible.
